Upper Patuxent Area Resources Under Evaluation for Historic Designation
Continuation of the Historic Preservation Commission Worksession: April 14, 2010
As part of the consideration of the Staff Draft Amendment to the Master Plan for Historic Preservation: Upper Patuxent Area Resources, the Montgomery County Historic Preservation Commission on April 14, 2010, will evaluate eight resources in Etchison and Clagettsville for individual designation in the Master Plan. These resources were identified at the March 10, 2010, worksession, during the Commission’s evaluation of historic districts in Etchison and Clagettsville. The resources to be considered include:
- Montgomery Methodist Protestant Church and Cemetery, 28201 Kempton Road, Clagettsville
- Ira Moxley/Harvey Moxley House, 28318 Kempton Road, Clagettsville
- Robert B. & Susan Moxley House, 28322 Kempton Road, Clagettsville
- Lewis and Laura Easton House, 28408 Kempton Road, Clagettsville
- Ottie & Tressie Moxley House, 28411 Kempton Road, Clagettsville
- Ollie & Lelia Moxley Farm, 28515 Kempton Road, Clagettsville
- Mt. Tabor Methodist Church, 24101A Laytonsville Road, Etchison
- Walter and Ida Allnutt House, 6920 Damascus Road, Etchison
The Commission will reopen the public record to accept testimony limited to these eight resources. Property owners and other interested parties may present testimony at the April 14 meeting. Written testimony is encouraged and may be sent to MCP-Historic@mncppc-mc.org or 8787 Georgia Avenue, Silver Spring, MD 20910. Testimony received by April 6, 2010 will be circulated to the Commission in advance of the meeting; after April 6, the public is requested to provide ten copies of written testimony for circulation at the meeting. The Montgomery County Historic Preservation Commission on March 10, 2010 held a continuation of the worksession to consider the Staff Draft Amendment to the Master Plan for Historic Preservation: Upper Patuxent Area Resources. The HPC took the following action:

The Montgomery County Historic Preservation Commission on February 24, 2010 held a second worksession to consider the Staff Draft Amendment to the Master Plan for Historic Preservation: Upper Patuxent Area Resources. Historic Preservation Commission: Public Hearing and Work Session [updated, 2.19.10]
The Montgomery County Historic Preservation Commission (HPC) on January 20, 2010, held a public hearing and work session to evaluate the historical and architectural significance of certain properties mainly located in the Upper Patuxent area of Montgomery County. The purpose of the public hearing was to allow the HPC to hear comments from owners, interested parties, and the public.
At the direction of the County Council, historic preservation staff is evaluating resources identified in the Locational Atlas and Index of Historic Sites in Montgomery County Maryland, the County’s inventory of potentially historic properties. Twenty-eight Locational Atlas resources and three resources identified during the survey of the Upper Patuxent area of the county are currently under consideration. Historic Preservation staff have prepared for the HPC’s consideration a Staff Draft Amendment, which includes staff recommendations as to which properties should be included on the Locational Atlas and/or designated in the Master Plan for Historic Preservation for Montgomery County, Maryland. Recommendations on the designation of properties are based on criteria set forth in the Montgomery County Historic Preservation Ordinance. At the conclusion of the public hearing, the HPC held a work session to consider public testimony and staff recommendations, and to develop its own recommendations for transmittal to the Planning Board as the Public Hearing Draft Amendment. The HPC unanimously approved the staff recommendation finding sixteen resources failed to meet the criteria for architectural or historical significance and recommending that the Planning Board remove these sixteen resources from the Locational Atlas. The HPC continued the work session to its February 24, 2010 meeting. At that time, the HPC will consider those resources staff has recommended for designation. The HPC has left open the public record and will accept written testimony received by 5:00, February 16, 2010. Written comments may be submitted to the HPC at 8787 Georgia Avenue, Silver Spring, 20910 or via email.
The Planning Board may remove from the Locational Atlas those resources determined not to meet the criteria for historic designation and add to the Locational Atlas those resources determined to meet the criteria for designation. The County Council will make the final decision on which properties should be designated on the Master Plan for Historic Preservation.
Properties included on the Locational Atlas or designated in the Master Plan for Historic Preservation are protected under relevant provisions of the Historic Preservation Ordinance. Properties on the Locational Atlas are subject to a moratorium on alteration or demolition, but with a procedure to allow the issuance of permits under certain circumstances. Properties designated on the Master Plan for Historic Preservation require review by the HPC for all new construction, exterior alterations, and demolition plans before the issuance of any permits. Master Plan properties are also eligible for County tax credits for repair, maintenance and/or restoration projects, and may be eligible for State tax credits as well.

Historic Preservation Staff Hold Community Meeting to Discuss Historic Properties and Districts
Historic Preservation staff held a public meeting on November 19, 2009 at the Damascus Recreation Center to discuss Montgomery County’s historic preservation program and provide the public with an overview of the ongoing evaluation of Etchison, Clagettsville and area properties for possible designation in the County’s Master Plan for Historic Preservation.
